WOOT! JUDGE TOSSES COMEY CASE! (DOCUMENT INCLUDED)
In a glorious, 29-page opinion (included for Notes from the Front members) Judge Cameron Currie just dismissed the lawsuit against James Comey, and excoriated the administration, calling Halligan’s appointment as an interim U.S. Attorney unconstitutional and “defective”. In fact the *very first sentence* of the opinion and order calls out her zero lack of experience as a prosecutor, saying “On September 25, 2025, Lindsey Halligan, a former White House aide with no prior prosecutorial experience, appeared before a federal grand jury in the Eastern District of Virginia.”
I read that and rubbed my hands together with glee, thinking to myself “Oh boy, this is gonna be good”, and it is!
The *only* thing that would make it more perfect would be if the case had been dismissed with prejudice (so the government couldn’t try to bring the case again), instead of without prejudice.
(NOTE: For everyone asking how the expiration of the statute of limitations will impact whether they can bring this again, I don’t know BUT a bit of quick research says what is logical: no, the case can’t be refiled. Which may be why the Judge did the ‘easy’ thing of dismissing it without prejudice. If I have time to research and find a more definitive answer I’ll let you know – or if a colleague reading this wants to do the research and chime in, that’d be swell.)
I’m not going to be able to go point-by-point here because just as I was typing this, JUST NOW, I got alerted that the case against Letitia James had just been dismissed too! So I’m going now to find that order for you.
