TO EVERYONE HOPING THAT THE MINNESOTA NATIONAL GUARD WILL TAKE ON ICE – STOP IT! JUST STOP IT!
The Minnesota National Guard has to walk a *very* fine line. With a flick of his finger (and we’ve seen him flick that finger this week) Trump can federalize the Minnesota National Guard right out from under Governor Walz; for Trump it would be just like a bully taking Governor Walz’ toys away. In fact I’m betting that he’s just *waiting* – *itching* – for the opportunity to do that.
It would also give him the pretext to invoke the Insurrection Act. Now I, and colleagues with whom I’ve had this conversation, think that the Court would smack him down, but in the meantime, until that happened, Trump would actually have the pretext he needs to send active duty military into the streets – by the time the Court got involved the military would have already been wreaking havoc in Minneapolis. We do *not* want to give him that opportunity.
I’m reasonably confident that the MN National Guard will have been fully briefed on what they need to do – and to *not* do – in order to avoid giving Trump an excuse to federalize them away from Governor Walz. I certainly hope so.
