PEOPLE PLEASE STOP FREAKING OUT ABOUT THE 8TH CIRCUIT STAYING THE ICE ORDER!
It is *nothing* more than an administrative stay – meaning it has *nothing to do with the merits* of the case. It is exactly what nearly always happens: the lower court says “You can’t do this”, the party enjoined says “Oh yeah? I’m going to appeal”, the appeals court says “We’ll pause the lower court ruling while we look into it”. That’s *all* that happened today. It *seems* bigger because of the subject matter, but it’s *normal* for the appeals court to stay something like that. Basically it is buying the administration a few more days until the appeals court can look at the actual matter. Again, it *feels* bigger because it means a few more days of ICE being basically unfettered, and that sucks, but in the *legal* context it means next to nothing.
