COURT REVEALS ORDER DEALING WITH GOVERNMENT’S VINDICTIVE PROSECUTION OF KILMAR ABREGO GARCIA
Darnit! I was –><-- this close to getting away without having to touch any real work this week! 😂
However, just today a court in the Abrego Gracia case revealed a 9-page order, *ordering* the government to produce documents which it has fought mightily to *not* disclose. Because, you see, they provide evidence that when the government arrested Abrego Garcia for human smuggling in Tennessee, it was almost certainly in response to - out of vindictiveness over - and probably even embarrassment about, having their little heinies spanked red by the Courts for illegally deporting Abrego Garcia to El Salvador.
While this court order was issued on December 3rd, it was issued under seal, and has just today been unsealed.
Says Judge Crenshaw, in the order (again, included for Notes members), "The Court has reviewed in camera over 3,000 documents that the government produced for review. For the reasons that follow, the Court will: (1) grant in part Abrego’s motion to compel discovery and require the government to disclose to Abrego a sub-set of the over 3,000 documents that are relevant to the narrow issue of whether the government’s new decision to prosecute Abrego, after deciding not to do so, “was tainted by improper motivation” arising from Abrego’s success in the Maryland civil case."
"In camera" means "in private", such as privately in the judge's chambers.
And while the Court is ordering the government to produce this discovery under a protective order, the Court *also* includes in its order a chart of the documents to be produced, and that chart includes quotes!
Bottom line, the government appears to be headed on the express train to deep doodoo station.
Notes from the Front members: the 9-page court order is in your inbox.
To protect myself from claims of improper republication, and trolls, I don’t publicly share documents I find, I make them available privately to Notes from the Front members. Often these are non-public documents for which I have had to pay out of my own pocket in order to share them with you. Others of them may be public but I find them for you and include explanations and insights based on my decades of law practice and as a law professor, with a side of snark. ;~)
You can join below for immediate access to this document, our archives, our private chat, etc.. - it’s $5 a month, which both keeps the trolls out, and helps to cover my expenses for our private dropbox, for purchasing transcripts for you, etc..
