ADMINISTRATION KEEPS TAKING MORE OF THE ROPE WITH WHICH TO HANG ITSELF

In the law, particularly in product liability law, there is a general rule that if a company fixes an issue (for example a product recall)  their act of fixing it cannot be used against them in the product liability case to prove culpability (as that would be a disincentive to fix things).

However that is NOT the case when a government screws up so badly that people are injured and even killed. In the past few weeks agents of the government, including Bondi, Trump himself, and now Homan have said things that I am sure will come back to bite them in court. For example where Homan here explains that “ICE and CBP plan to focus on “targeted” enforcement actions rather than sweeping patrols, in which agents conduct traffic stops and foot patrols to check the immigration status of individuals they encounter, and then says, quote:

“Targeted enforcement operations is the way we’ve always done it and I think we got away from it a little bit.”

You may simply see a soundbite above, but I see one of many subtle mea culpas that can be stitched together to paint quite a damning picture in court. And I’m sure that they will be.
