A federal appeals court has blocked the Trump administration from invoking wartime powers under the Alien Enemies Act to deport migrants. In a 2-1 decision, the court rejected the claim that immigration (even on a large scale) constitutes a military breach of U.S. borders. Writing for the majority, Judge Leslie H. Southwick explained: “A country’s encouraging its residents and citizens to enter this country illegally is not the modern-day equivalent of sending an armed, organized force to occupy, to disrupt or to otherwise harm the United States.”
