A free speech watchdog filed a new lawsuit challenging the legal framework the Trump administration has used to detain and seek the deportation of foreign students over their expression.

Brought on behalf of Stanford University’s student newspaper, the case contends that several staffers have either resigned or held back from publishing certain content due to fears of possible government retaliation.

Unlike earlier cases that focused only on the arrests, this lawsuit, filed in California, zeroes in on a provision of the Immigration and Nationality Act of 1952. That statute grants the secretary of state sweeping authority to declare a noncitizen a threat to U.S. foreign policy and make them deportable. The Trump administration has invoked this power to target foreign students who took part in pro-Palestinian protests. The suit argues that applying this law to punish speech or activities protected by the First Amendment is unconstitutional.
