The EPA is preparing a proposal that would revoke a critical 2009 legal determination stating that greenhouse gases are harmful to human health. That finding has been the backbone of U.S. climate regulations for over a decade.

Why is this significant? The 2009 “endangerment finding” legally obligated the federal government to limit greenhouse gas emissions under the Clean Air Act. Without it, many existing climate protections, especially those targeting vehicle emissions, could be dismantled.

The proposal is still in draft form and could change. The draft includes removing all current limits on greenhouse gas emissions from cars and trucks.

A document titled “Greenhouse Gas Endangerment Finding and Motor Vehicle Reconsideration Rule” is listed on a government website as being under review by the Office of Management and Budget, though no details have been made public. If the rule moves forward, it would need to go through a public comment process before becoming official.
