The Trump administration handed over the immigration status of millions of Medicaid enrollees to deportation officials, data that could be used to locate and remove people as part of his sweeping crackdown. Resistance members fought to stop the transfer, but some were placed on administrative leave for standing up. The data handoff was illegal. Federal law, including the Social Security Act and the Privacy Act of 1974, strictly limits how personal health information can be used. Medicaid data is protected and cannot be repurposed for immigration enforcement without violating those statutes. CMS staff raised legal alarms, but political appointees overrode them.
