Because it’s too vague and was never meant to apply to someone like him a U.S. resident who never left the country. The judge said the government failed to prove Khalil’s actions affected foreign policy, and called his potential deportation under this law “unprecedented.” This is a major win for due process and a reminder that not all government actions hold up in court.
