Disparate impact means that even if a policy isn’t intended to discriminate, it can still be illegal if it ends up disproportionately harming one group over another. That matters because many forms of discrimination today are subtle and hidden in data. By ending this protection, the government is making it much harder to prove discrimination unless someone openly admits to it. This move also cancels rules that warned schools not to unfairly discipline students based on race.
