Lawsuit filed by the Democratic National Committee, the Democratic Senatorial Campaign Committee, the Democratic Congressional Campaign Committee, the Democratic Governors Association and the party’s Senate and House leaders against the Trump administration challenging provisions of Executive Order 14248 which could disenfranchise millions.
Democrats argue that the president seeks to expand the executive branch’s power over federal elections by targeting states with extended ballot receipt deadlines, imposing a documentary proof of citizenship requirement for the federal voter registration form, threatening the independence of the Election Assistance Commission, requiring federal agencies to share sensitive voter information with the Department of Government Efficiency and conditioning election funding for states on compliance with the order.
The plaintiffs assert that provisions of the order violate the U.S. Constitution, the Administrative Procedure Act, the National Voter Registration Act and other federal laws. Additionally, they claim that President Donald Trump has exceeded his constitutional authority in his attempt to regulate federal elections — constitutional powers that lie with Congress and the states. Democrats seek to block the administration from implementing several provisions of the order related to documentary proof of citizenship requirements, conditioning state election funding on compliance, sharing sensitive voter information, extended ballot receipt deadlines and more.
