Lawsuit filed by the Democratic National Committee (DNC) and its congressional campaign arms against President Donald Trump (R), Attorney General Pam Bondi, the Federal Election Commission (FEC) and its commissioners challenging Executive Order 14215, which purports to give Trump and his administration authority over independent agencies. In 1974, Congress established the FEC as an independent agency to regulate and enforce federal campaign finance laws. E.O. 14215 asserts that Article II of the U.S. Constitution gives the president complete and total control of the executive branch, including independent agencies like the FEC. The plaintiffs argue that this executive order threatens the constitutionality of the FEC and violates the Federal Elections Commissions Act (FECA), which gives the FEC commissioners sole authority over the agency. They ask the court to block the Trump administration from enforcing EO 14215 and rule on the constitutionality of independent agencies.
STATUS: The plaintiffs filed their complaint on Feb. 28, 2025. Trump has not responded yet.
